昨天我谈到了res ipsa loquitur，借着今天套用IRAC模式呈现一首法律情诗。
Love v. Res Ipsa Loquitur
Issue: How can I prove that I love you?
Rule: The doctrine of res ipsa loquitur requires the plaintiff to show that the accident causing the injury is a type that would not normally occur unless someone was negligent and the negligence is probably attributable to the defendant. The plaintiff can still lose, however, if the inference of negligence is rejected by the trier of fact.
Analysis: If I assert that I love you, I need not to prove it. Because it is res ipsa loquitur, that is, I would not normally hold such rich and complex feelings unless I loved you, but it is unfortunate for me that res ipsa loquitur is merely a permissible reference, the power of permissibility belongs to you, the trier of fact, and if you abuse your power and reject my claim, I would fail.
Conclusion: Res ipsa loquitur is inefficient to prove that I love you, I should produce more evidence to support my claim.

我根本不需要证明它
因为这是一种事实自证
也就是说
除非我爱你
否则我不会出奇的拥有如此丰富且多元的感受
然而
这对于我来说是可悲的
事实自证仅仅是一种可经允许的推理
你以一个事实审判者的姿态
拥有允许权
如果你滥用你的权力并驳回我的诉求
我将败诉
事实自证是不充分的
我仍将需要提供更多的证据
证明我爱你
